TERMS AND CONDITIONS
The Foster dog will not be left off leash in an unfenced yard at any time. The Foster parent will keep the provided collar and tag on the dog at all times. The Foster parent will take proper care of the Foster dog, including providing adequate food, water, shelter, and appropriate exercise. If medical problems arise, the Foster parent will contact Terriers R Us immediately for emergency treatment. The Foster parent will bring the dog to an authorized Terriers R Us veterinary clinic. Terriers R Us is not responsible for any events and/or damages that may occur as a result of fostering the dog.
The Foster dog remains the property and sole ownership of Terriers R Us, regardless of location. The Foster dog will be surrendered to Terriers R Us immediately upon request, and will be returned to Terriers R Us if the Foster parent can no longer care for the dog or at the request of the Board members. The Foster dog cannot be transferred to another party or location without approval from Terriers R Us.
The Foster dog can be adopted to its permanent home ONLY with approval of Terriers R Us and ONLY within our standard adoption protocol; the Foster parent may refer potential adopters directly to Terriers R Us. If the Foster parent is interested in adopting, they may do so in accordance with our standard adoption protocol, which includes completing an application and paying the appropriate adoption fee.
FOSTER APPLICANT AGREES TO THE FOLLOWING: “If I would like to adopt the dog, I will advise Terriers R Us and follow all proper procedures. I understand that while I have been fostering this dog, it does not guarantee permission to adopt. I understand Terriers R Us makes the final decision regarding adoption, which is based on the best interest of the dog, legally the property of Terriers R Us.”
It is understood by the Foster parent that failure to comply with the terms of this agreement will result in the immediate return of the dog to Terriers R Us. If the Foster dog is not surrendered immediately upon request, legal action required to retrieve the dog will be initiated. This action may include recovery of the dog's property value, as well as the Foster parent's liability for reimbursement of legal expenses to Terriers R Us incurred to enforce this contract.. Terriers R Us does not make any guarantees as to the health, temperament, mental disposition, or training of the Foster dog. The Foster parent agrees to foster the dog at their own risk, fully and completely releasing Terriers R Us, its founder, and volunteers from any and all claims and liability, including but not limited to any defects or illnesses the Foster dog may have or develop, and for any injury or damages to person, property, or other household pets which may be caused by the Foster dog.
The Foster parent agrees to indemnify and hold Terriers R Us harmless against any and all claims and liability, including but not limited to those asserted by third parties for any injury or damage to persons or property caused by the Foster dog. The Foster parent certifies that all animals in the home are up-to-date on vaccinations and in good overall health, and fully and completely releases Terriers R Us from any and all claims and liability for any illness that animals in the home might develop, even if such illness might have been transmitted from the Foster dog.
Terriers R Us will not release a dog to any Foster applicant without clearance from the vet, unless previously discussed. The Foster parent certifies that they have read this agreement in full and understand all the Terms and Conditions. The Foster applicant understands that any misrepresentation about them or the home environment, or failure to abide by all the Terms and Conditions in any way that jeopardizes or adversely affects the health and welfare of the Foster dog, may result in Terriers R Us reclaiming the dog immediately and without prior notice, irrespective of any expenditures the Foster has made, and Terriers R Us may pursue legal means to do so if necessary. This contract for Foster care is legal and binding, governed by the laws of the State of California.
